Man Rear-Ended at Stop Light – $391,424

We recently helped a 38-year-old man who was hurt in a Chicago car accident. Waiting for the light to change at 179th and LaGrange in Tinley Park, he was rear-ended and sustained severe spinal injuries. Upon going to the doctor, he was diagnosed with a herniated disc in his cervical spine, which would require future fusion surgery to treat and repair the disc. A costly procedure, the man wondered how he was going to manage time away from work, paying for surgery, and ongoing medical expenses while recovering from the pain and trauma of the accident. He hired Chicago personal injury lawyer Jared Staver to handle his auto accident case. Before the trial, the insurance company for the driver whose negligence caused the accident offered to settle the case for $110,000. Since this amount would not sufficiently cover the damages the client suffered, Jared rejected the offer and worked to bring this case to trial. He achieved a policy award that exceeded the other driver’s insurance policy limit of $250,000. This happened because Jared collected directly against the insurance company for failing to settle the case before trial within their policy limits. The client was ultimately awarded $391,424.16 for the pain and suffering he experienced because of the rear-end accident.

Trial Verdict for I-55 Car Crash 11x Higher What Insurance Company Offered

Recently, a salesman in his early 40s was hurt in a car crash on I-55 near Chicago. He sustained soft tissue injuries to his back and neck because of the accident. Because the auto accident was a relatively minor impact, the man delayed on getting the treatment he needed. But soon the persisting pain led him to seek out a chiropractor for his injuries. The man ended up accumulating roughly $11,000 in medical bills for chiropractic treatments. These sizable bills became burdensome and he sought out Tyler Kobylski, a Chicago personal injury lawyer with Staver Accident Injury Lawyers, P.C., to handle his case.

The driver whose negligence caused the accident possessed auto insurance, and prior to trial the insurance company offered $1,000 to settle. Tyler advised the client to turn down the offer since it would barely cover any of the medical bills he had accumulated because of the accident. We took the claim to trial, and in the end the jury came back with a roughly $11,000 verdict – a very good result for our client. The verdict amounted to 11 times the amount that insurance company initially wanted to offer. Our client was extremely happy with the outcome of the case because it covered the medical expenses he had accrued.

Rear-End Accident Settles for 100x What Insurance Offered

On May 15, 2014, a 30-year-old man was rear-ended by a driver when he was heading westbound on I-290 in Chicago. He received a $500.00 check in the mail along with a settlement offer from the other driver’s insurance company. Thinking that seemed low for covering his injuries, he called Chicago personal injury firm Staver Accident Injury Lawyers, P.C. to see if he should cash the settlement draft.

The man told us he continued to have back and neck pain following the accident. We advised him not to accept the offer and to seek immediate medical attention. He became our client, and after receiving medical diagnosis we learned that he had a herniated disc in his neck as a result of the collision. This injury made him a candidate for anterior cervical discectomy and fusion surgery at C4-C5. We were able to secure a settlement for 100 times the original offer to the client at the maximum amount of the negligent driver’s insurance policy, and we were able to accomplish this prior to going to court and trial.

Injured High School Student Hurt in Rear-End Accident – $95,000

A high school senior was stopped at the intersection of Roselle Road and Valley Lake Drive in Schaumburg, Illinois when she was rear-ended by a drunk driver. As a result of the collision, she suffered from sacroiliac joint disfunction, causing severe lower back pain. The negligent driver’s insurance company offered just $9,500.00 to settle her claim. She hired attorney Jared Staver to file a lawsuit on her behalf.

By putting pressure on the defendant and seeking to settle the case quickly, Staver Accident Injury Lawyers, P.C. sought punitive damages against the negligent driver for reckless conduct. The court granted Staver Accident Injury Lawyers, P.C. permission to seek punitive damages, and the insurance company then agreed to settle the case for $95,000.00 – ten times the original offer.

$90,000

T-Bone Accident at Harlem & Cornelia in Chicago – $90,000

As a result of the accident, he suffered a partial tear of his rotator cuff, requiring months of physical therapy and future surgery. After recovering the policy limits from the other driver’s insurance company in the amount of $20,000, the Chicago personal injury lawyers at Staver Accident Injury Lawyers, P.C. pursued an underinsured motorist claim against the client’s insurance company. While the client’s insurance company offered to settle the case for an additional $32,000, Staver Accident Injury Lawyers, P.C. demanded arbitration and was able to secure an additional $70,000, putting the client’s amount at a grand total of $90,000 – over twice the initial offer.

$100,000

Chicago Pedestrian Accident Near Western & 71st – $100,000

We recently settled a case for a 51-year-old man who was attempting to cross Western Avenue near the intersection of 71st Street when he was struck by a speeding motorist. He was transported by ambulance to Advocate Christ Medical Center in Oak Lawn, Illinois. Upon seeing a doctor, he was diagnosed with multiple abrasions as well as a fractured leg. Injuries that come about from pedestrians hit by a car can be severe. The man underwent surgery to set his broken bones.

The motorist who struck the man was insured under a $100,000.00 policy, and the person’s insurance company initially tried to argue that the motorist was not liable to our client because our client crossed the street in the middle of a block (instead of a crosswalk). Our lawyers were able to demonstrate through evidence we collected that the motorist was speeding at the time of the collision. The case ultimately settled for $100,000.00 prior to trial – the policy limit of the motorist and his insurance company.

$100,000

Accident at Keeler & Irving Park Road – $100,000

A 32-year-old man was driving south on Keeler near the intersection of Irving Park Road in Chicago when another driver failed to stop at a red light and struck the man, who became a Staver Accident Injury Lawyers, P.C. client.

Our client sustained a tear in his right elbow, and as a result of the tear, he had to undergo a right elbow extensor tendon repair, a lateral collateral ligament repair, and a medial collateral ligament repair. Our client endured substantial restrictions to his lifestyle in the months following the accident and has sustained a permanent scar on his right elbow as a result of the surgical procedures.

After intense negotiations, our Chicago personal injury lawyers successfully argued for the other driver’s insurance company to offer the full amount of the policy limits prior to filing a lawsuit. This amounted to $100,000.00.

$100,000

Car Accident on Route 83 Settles for $100K

On May 4, 2014, an intoxicated driver turned directly into the path of our client, a 55-year-old female, on Route 83 near Valley Road in Downers Grove, Illinois. Our client sustained multi-level injuries to her cervical spine. An MRI of our client’s cervical spine found broad based disc protrusions (herniations) at C4-5 and C6-7, which caused intense pain and radiculopathy due to the compression on her nerves.

Despite the other driver who caused the accident pleading guilty in traffic court to the offense of reckless driving, his insurance company failed to offer a reasonable settlement amount. As such, the lawyers at Staver Accident Injury Lawyers, P.C. filed a lawsuit on behalf of our client in the Circuit Court of DuPage County. We were able to convince the judge assigned to the case to grant us the ability to ask for punitive damages at a jury trial due to the defendant’s willful and wanton reckless conduct in driving while under the influence of alcohol. After lengthy negotiations, we were able to convince the insurance company to pay $100,000.00 dollars to settle the case, which was the maximum amount of their insurance policy.
