Fleeing Suspect Rear-End’s Client, Settles for Full Amount at $20k

Attorney Jared Staver was recently contacted by a 29-year-old male who was in a multiple vehicle accident by an (uninsured motorist) on Interstate-94 near the 33rd Street exit. The uninsured motorist stole a vehicle and was fleeing police in a high speed chase when he rear-ended another vehicle who then rear-ended our client’s vehicle. Our client was transported to Mercy Hospital by ambulance and treated for injuries from the rear-end collision.

Following up with his primary care physician our client had an MRI and ordered to undergo months of physical therapy treatments for the injuries he sustained from the collision. Discovering the at-fault driver was an uninsured motorist, our client was worried about the thousands of dollars in medical expenses, bills, lost wages and the pain and suffering he experienced as a result of the rear-end collision. Without the at-fault driver being insured our client was not sure how these expenses would be covered for payment. That’s when our client contacted Staver Accident Injury Lawyers, P.C. who filed an Uninsured Motorist Claim with our client’s own insurance company. Our Chicago personal injury attorneys successfully negotiated on behalf of our client and within three months settled for the full insurance policy claim at $20,000.00

Car Accident on Route 83 Settles for $100K

On May 4, 2014, an intoxicated driver turned directly into the path of our client, a 55-year-old female, on Route 83 near Valley Road in Downers Grove, Illinois. Our client sustained multi-level injuries to her cervical spine. An MRI of our client’s cervical spine found broad based disc protrusions (herniations) at C4-5 and C6-7, which caused intense pain and radiculopathy due to the compression on her nerves.

Despite the other driver who caused the accident pleading guilty in traffic court to the offense of reckless driving, his insurance company failed to offer a reasonable settlement amount. As such, the lawyers at Staver Accident Injury Lawyers, P.C. filed a lawsuit on behalf of our client in the Circuit Court of DuPage County. We were able to convince the judge assigned to the case to grant us the ability to ask for punitive damages at a jury trial due to the defendant’s willful and wanton reckless conduct in driving while under the influence of alcohol. After lengthy negotiations, we were able to convince the insurance company to pay $100,000.00 dollars to settle the case, which was the maximum amount of their insurance policy.

He was transported by ambulance to Advocate Christ Medical Center in Oak Lawn, Illinois. Upon seeing a doctor, he was diagnosed with multiple abrasions as well as a fractured leg. Injuries that come about from pedestrians hit by a car can be severe. The man underwent surgery to set his broken bones.

The motorist who struck the man was insured under a $100,000.00 policy, and the person’s insurance company initially tried to argue that the motorist was not liable to our client because our client crossed the street in the middle of a block (instead of a crosswalk). Our lawyers were able to demonstrate through evidence we collected that the motorist was speeding at the time of the collision. The case ultimately settled for $100,000.00 prior to trial – the policy limit of the motorist and his insurance company.
