Recent Payless ShoeSource Premises Liability Incident

In March 2018, a 2-year old girl was browsing near a full-length mirror while shopping with her family at a Payless ShoeSource. The mirror was not secured properly and toppled onto the young girl. The mirror was so massive that her family had difficulty moving it, and the little girl suffered from internal bleeding and lost a great deal of blood by the time paramedics arrived. Sadly, she passed away shortly after.

There were other premises liability incidents similar to the one that occurred at Payless ShoeSource that took the lives of innocent children. For instance, in February 2017, a 10-year old boy lost his life after he hit his head on a display barrier at Topshop.

Distracted parents and hazards in establishments such as department stores can pose serious dangers for children. Payless ShoeSource is currently working with authorities to determine how this accident occurred.

The 2-year-old’s family recently filed a premises liability claim against the shoe store, seeking damages of $200 million. They are also asking Payless ShoeSource to ensure all shelves and mirrors are adequately secured, so others never have to suffer from this type of tragedy.

Determining Liability in Premises Liability Cases

Customers of department stores and other businesses that are open to the public are legally protected from harm. If a customer sustains an injury, a property owner may be liable under premises liability.

Typically, the property owner and business owner are separate parties. Therefore, determining liability in a premises liability case like the one that occurred at Payless ShoeSource can be complicated. Outside vendors may also play a role in a case, making it essential to seek legal representation if you or a loved one has been a victim of a premises liability accident. A premises liability lawyer can assess your case, collect evidence, and help you hold the correct party accountable for their negligence.
