We recently settled a case for a 51-year-old man who was attempting to cross Western Avenue near the intersection of 71st Street when he was struck by a speeding motorist. He was transported by ambulance to Advocate Christ Medical Center in Oak Lawn, Illinois. Upon seeing a doctor, he was diagnosed with multiple abrasions as well as a fractured leg. Injuries that come about from pedestrians hit by a car can be severe. The man underwent surgery to set his broken bones.
The motorist who struck the man was insured under a $100,000.00 policy, and the person’s insurance company initially tried to argue that the motorist was not liable to our client because our client crossed the street in the middle of a block (instead of a crosswalk). Our lawyers were able to demonstrate through evidence we collected that the motorist was speeding at the time of the collision. The case ultimately settled for $100,000.00 prior to trial – the policy limit of the motorist and his insurance company.
