5 Things to Do If You’ve Been in a Chicago Highway Accident

by Jared Staver in Auto Accidents, Personal Injury, Wrongful Death

The unthinkable has happened. You have been involved in an accident on the highway. The question in many motorists’ minds is what they should do when involved in an accident on the highway. The experienced personal injury and accident attorneys of Staver Accident Injury Lawyers, P.C. would like to take this opportunity to let you know the things that are absolutely essential to do in the event you are involved in an accident on the highway in Chicago or anywhere in Illinois.

  1. Get Off the Road — If you are able, pull your vehicle to the side of the road immediately after any accident. Exiting your vehicle in the middle of traffic can be extremely dangerous, as you will have to weave in and out of speeding traffic to get to safety at the side of the road. This is extremely dangerous. That is why it is essential that you pull your vehicle to the side of the road and exit it only once you have safely gotten yourself and any of your passengers outside the zone of danger.

  2. Call the Police — After you have ensured that yourself and all of your passengers have safely made it to the side of the road, make sure to call the police and tell them that you have been in an accident and ask that a unit be dispatched to your location so that an accident report can be completed. If the other driver tries to convince you that it is better to just “handle things between the two of you,” this is a huge red flag, particularly if the other driver’s behavior caused the accident. Insist firmly that the other driver stick around until the police get there. The police are experienced at investigating accidents and having a police report describing the circumstances of the accident is absolutely essential later on in any legal proceedings that may follow the accident. Such a report is objective, unbiased evidence of what happened from investigators who are expert at dealing with automobile accidents and could prove vital to proving your case.

  3. Get The Other Driver’s Insurance Information — After you have called the police, the next thing to do is to exchange insurance information with the other driver. In particular, make sure that you get the name of the other driver’s insurer, policy number as well as any other identifying you can, such as the other driver’s name, address, telephone number, driver’s license number and his or her license plate number. This information will become very important in ensuring that you receive compensation for any injuries or financial losses, including damage to your car, that you suffered in the accident, as the party that will be most important in any subsequent negotiations and any subsequent lawsuit that is filed will be the other party’s insurer.

  4. Seek Medical Treatment Right Away If You or Any of Your Passengers Have Been Injured — If you or anyone else in the car with you was injured in an automobile accident, it is important to seek treatment as soon as possible afterwards. Delaying seeking treatment can make it more difficult to prove that your injuries were caused by the accident, particularly if you wait a long time to seek such treatment. This can make it more difficult to eventually recover any expenses related to that treatment either in a lawsuit or in negotiations with the other driver’s insurer because a jury or the other driver’s insurer may be skeptical of any claims that your injuries are related to the accident if you delay in seeking medical treatment.
